Above is an excerpt from the March 21 2024 the VOJ board meeting. These are the notes taken concerning the removal of the variance.
The removal of the variance required the Pistakee Yacht Club to have to amend the request for a declaratory judgement. Following the amendment, the VOJ has continued legal maneuvering dragging out the proceedings and preventing any rulings on the variance.
The variance was approved by McHenry County in 1970 when they had jurisdiction in the area.
During the annexation in 1991 all existing variance were adapted.
Attorney Smoron made reference to the public not being properly notified when the variance was granted. This is his opinion and has not been ruled on by the judge. McHenry County records for the variance include records of notification concerning the variance.
