December 10, 2024 the Judge denied 5 of 6 motions by VOJ to strike or dismiss the Pistakee Yacht Clubs claims concerning the variance.
The judge granted one motion without prejudice to replead. This means that the judge asked PYC for clarifying information for one claim and the order states the PYC should provide that information by January 3, 2025. In the proceeding the judge gave indication of the type of information he would consider with that claim.
In the 01/30/2025 VOJ newsletter it did not indicate the dismissal was without prejudice leaving out the fact the claim could be repealed within 28 days and the letter characterized the repealed as the filing of another complaint.
PYC complied with a court to order and responded to the judge’s request by January 3, 2025. VOJ had until January 31, 2025 to respond.
